Severalbusinessesthatsellvapes,aswellastheKentuckyHempAssociationandKentuckyVapingRetailersAssociation,aresuingthestategovernmentoverHouseBill11,whichwillrestrictvapesalesstartingin2025.
Amongotherpolicychanges,HB11willbarbusinessesfromsellingvapesthateitheraren’tauthorizedbytheU.S.FoodandDrugAdministrationoraren’tinthemidstoftheapprovalprocess.
Thousandsofnicotinevapingproductsfeaturingadizzyingarrayofflavorsaresoldacrossthecountry,butonly23havetheFDA’ssignoff.
HB11’sleadsponsor,GOPRep.RebeccaRaymerofMorgantown,saidinaMarchmeetingthatthegoalistogetvapeproducts“offthemarketthatwerebeinggearedtowardourchildren.”
“Once[theFDA]becametheregulatoryauthorityoverthisin2016throughCongress’direction,theyhavesetguidelinesforwhatcouldstayonthemarket,”Raymersaid.“Wearenotmakinganythingillegal.WearesimplyfollowingwhattheFDAhasputinplace.”
