TheSmithfamily,wholiveinErlanger,issuingtwoFlorencerestaurant:TwinPeaksandKickShotBilliards.Theyaresuingthetwoestablishmentsforservingalcoholtominorsandgrossnegligence.They’realsosuingFATBrandsfornegligence,whichisthecompanythatownsTwinPeaks.
“Inthiscase,thisTwinPeakschosenottocardatablefullofkids.Theychosetoservehimshotsandbeers,”saidDavidBarber,theattorneyrepresentingthefamily.
BarbersaidalcoholcontributedtoanincidentinMarch2023thatresultedinSeanSmithsufferingsevereandpotentiallyfatalinjuries.After19-year-oldSeanandhisgrouplefttherestaurantstheywenttostatepark.Seanwassittingonthebackofacarwhenthedrivertookoff,andSeanhittheground.Barbersaidhewasconsciousforashortperiodoftime
